Hi,

Has anyone ever tried a writ of mandamus to get a final decision if the processing time has been exceeded?

I personally haven't seen any in the caregiver category but of course very possible it has happened.

On this forum, we seem to see mandamus used most frequently for citizenship applications that have taken much longer than the posted processing time (e.g. 2 year processing time but applicant has been waiting 3 years).

Thanks. They may not look upon it favorably given the strike and the fact that they're claiming the pilots aren't held to the same processing standard. In fact, they say they have no processing standards to uphold.

From what I've seen on this forum, if you're willing to shell out the lawyer money, this can be a very successful way to get things done if the estimated processing time has been significantly exceeded for your application.

The fee for the application alone is $2000.

I know a Jan 2022 HCCP applicant who submitted mandamus. Their application was processed faster. The children of the Employer had Autism.

Excellent! I know some people who have successfully submitted information for more dire cases to be processed faster. I think they just used web form.
