Hello,
My sister is a teacher in another country. She applied for her teacher's license in Canada and is currently awaiting the evaluation results. However, she applied for a teaching position at my school on a First Nation Reserve where we are always short staff. I spoke to my principal and she was interviewed via skype and won the competition (to be honest I don't think anyone else had applied). She has received a letter of offer, and a contract. In the offer letter it did say that her salary was the set amount until she receive her teaching license from the teacher regulation authority in the province. It also states that she will have insurance benefits and accommodation will be provided and the rent will be deducted from her biweekly salary.
We are at the stage now where we are applying for the work permit, and we do not have a LMIA as none was done. However, we have created the profile after selecting the "LMIA exempt" option. There is an IMMI5802 form but it is listed in the optional documents section. Besides that, we have uploaded all the other documents, including the current letter of employment, copies of her qualifications, employment records, and the necessary forms. We are however worried that she might not get the work permit since there was no LMIA. What are her chances? She already have a visitor's visa, do you think it would make a difference if she come to Canada as a visitor and apply for the work permit from here?

The potential employer needs the LMIA. Teachers from abroad are usually not able to get licensed based on their foreign education. Also there is no point, in my opinion, to apply until she hears whether she is able to teach. I can't imagine that she will get a work permit as a teacher if she isn't qualified to teach in Canada.
Furthermore the school should be more than aware they are required to hire individuals licensed to teach in the province.

Her employer is required to obtain an approved LMIA before she can apply for a workpermit.
No - beign ain canada as a visitor won't make a difference.
Not true, I am a licensed teacher in the same province you are talking about. Just got my license last and was teaching since January. In terms of the LMIA i cant speak to that as I am living here and holds a open work permit so there was no need for me to apply for one.

Your situation is TOTALLY different then the O/P. You have an open work permit which negates the need for a LMIA.

With that said i clearly stated i was not responding to the LMIA, but the teachers license where it was stated foriegners are not able to get a licence with there foreign qualifications
