American hubby just got through border at Niagra--but they want him to leave in 5 weeks. This is probably because he was here before for a few months, and was only out of Canada for 2 months. We are almost ready to start our PR application--we have paid the Sponsor and Principle Applicant fees (and he had the receipt with him to prove it). My question is: Given that there was an issue at the border (they scrutinized his folder with PR paperwork in it, and even made him show them pics of our wedding on his phone), do you think there will be an issue getting an extension from CIC for him to stay longer than the 5 weeks? Because now I'm wondering, if we rush, and get the app in as an inland within 5 weeks, he for sure won't have to leave (and will be able to get the OWP. But outland was the way we wanted to do this.

Apply for an extension of his visitor status http://www.cic.gc.ca/english/information/applications/visitor.asp in no later than 1-2 weeks. There's no telling what the decision will be on that, but it's best to try. With PR application in process and proof that you will support him in Canada (you could write a letter of support) and proof of funds then he most likely won't have an issue.
Apply outland. I applied in April and my application is already "in process" and I am expecting DM at any time now. Americans are processed through Ottawa generally, interviews are very rare, and you will likely be processed in 2-4 months. He can apply outland from within Canada. The OWP with the inland application takes 4-5 months to get.

CIC is not CBSA. They are entirely different agencies with entirely different ways of looking at situitions. With the PR fee receipt and proof of finances, there should be no issue getting an extension from CIC.
