We found out the Lawyers Licence had expired when he signed our Nikka in 2010

Dear Forum,

Just today my husband in Pakistan received a letter from the High Commission in Islamabad stating that the lawyer who signed our Nikka in 2010 his licence had expired in March 2010. My husband got him to sign in April 14,2010. He was not aware that this man's licence had expired and the lawyer thought maybe it had expired and the thing is he has not had it renewed since then because the place where they renew licences has been too busy. but he still has been practicing as a Lawyer.

Please can someone help guide us in this matter. We have been waiting since Sept 2010 when we applied and to find this out now and at the end as they finished with everything only this important matter with the Lawyers Licence not being valid. PLEASE HELP GUIDE US.................

You probably need to talk to a qualified lawyer in Pakistan who can tell you whether you are legally married under Pakistani law, and if so, how to prove it to CIC. For example, this could be done by quoting relevant Pakistani laws, and perhaps obtaining a legal opinion.

If the answer is that you are not legally married, then re-marry and apply again, but write that you would like urgent processing on the basis that, for reasons that were not your fault, you didn't realize that you weren't already married, and that you have already been waiting for a long time.

You should probably also talk to a Canadian immigration lawyer to see what needs to be done.

This is a question of Pakistani law, since you were married there. You need to convince CIC that Pakistan considers you legally married.

Otherwise, you will likely have to re-marry and apply again, asking for special consideration with respect to processing times.
