My common law spouse came over 14 months ago from the US visiting, and extended his stay while here. When we decided he would immigrate up here we began keeping track of paperwork, etc. Anyways we filed common-law last month and he is still here, on implied status as he is waiting for the decision on his 2nd visitor visa extension request (sent in november, should hear back in march or april). We showed proof of the fee's being paid, the FBI payment coming out of our visa, etc when we sent in the request asking for him to continue visiting while his PR is being processed.
Anyways, we are hoping to visit the US for a day in March. Do you think he is going to have a hard time coming back into Canada with me if we cross into Detroit for a day? I will be bringing a copy of the fee's that were paid, and if I have the sponsorship approval letter by then I will have that, and a copy of the letter my employer wrote for me regarding my employment that we sent in with the application..
My worst fear is him not coming back home with us and him being stuck at the POE
So in theory he is Ok to leave and return. And as a US Citizen he should have no issues.
The question is do you really want to take a risk for one day in the US?
Can I ask, why did you apply for an extension if it is technically OK for him to travel between the US and Canada?
The last time he crossed he had a little bit of a hard time. What saved him was his letter from his employer stating he was due back to work 4 weeks after he crossed. Now, he doesn't have a job as he has been up here 13 months and he can't work. However, with the papers processing and now that we are common-law I was hoping it was a little easier to cross
Well you could carry the receipt and copy of the application.
Lets face it, if he is refused entry it wont be good.
If I was in your position, knowing he had a hard time on the last crossing, I would wait until the PR is approved.

Hey! Just an idea, why don't you go to the border, and while he stays at Niagara taking pics of, let's say, the falls, you cross over to the US and do the grocery shopping for him?
