I just requested GCMS notes for my brother because he applied for visitor visa and got rejected in May 2017. i did it thru Privacy act and submitted Consent form as well and didn’t to pay $5.

or I will have to do it again thru Access to Information Act to request notes on his application.

No. Privacy Act is only allowed when ordering your own records. ATIA is for ordering someone else's information, and you should pay $5. Apply again using ATIA at the link below. You can reuse the same consent form you sent.
