Hello

I want to apply for PR card renewal for the second time. ( It will be my 3rd PR cad). I have decided to apply in January 1st, 2015 about 4 months before my current PR card expiration date (April 2015). I am just wondering If I should consider 5 years before the application submission date ( Since January 1st, 2010) for residency obligation or the 5 years interval starts from my first PR card expiration date (April 2010) .

If I consider the 5 years interval from January 1st, 2010 to January 1st, 2015, I will meet the residency obligation of 730 days and I can apply for renewing my PR card on January 1st . But If the 5 year interval starts from the expiration date of my first PR card (April 2010) , I should wait until April 2015 (My current PR card expiration date) to meet the residency obligation .

I don't know what to do. I might need to leave Canada after January . I need to decide sooner than later

Foremost: Follow the instructions when completing the application. If you follow the instructions this question evaporates.

For a PR who has been a PR for more than five years, the travel history portion of the application for a new PR card clearly refers to "the last five years." Nothing ambiguous or confusing about this. It asks for travel history for the five years preceding the date of the application.

If the application is made less than five years since the previous application for a new PR card, which in most cases it would be (unless the PR allowed their PR card to expire, which many do, which is OK and has no impact on PR status), sure, the travel history in this application will overlap that given in the previous one. So what? (Well, of course both need to be accurate, and thus both should be consistent with each other for that time period.)

Reminder: the date of validity on a PR card does not affect a PR's status. A PR must have valid status and be in compliance with the PR Residency Obligation, and otherwise not inadmissible, to be issued a new PR card. But the PR's status itself is not affected by whether the PR has a currently valid PR card or not, or by what date the PR card is valid until.
