Hi guys, from beforehand im thanking anyone who can help me out with this one.

My husband in Canada is ordering our first gcms notes. We are totally lost as to what to do. We have looked in threads and they have different info as to what is the concent form I should fill and send to my husband. The IMM5744 or the use of a representative imm5476? Can someone please help us :-*

The Sponsor completes IMM5563 and the Applicant signs and completes IMM5744. The instructions and fee are explained on page 1 of form IMM5563.

IMM5476 is no longer accepted for ordering GCMS notes effective January 1, 2013.

If you have any questions about how to fill out either form, please ask!
 
please correct ne if Im wrong. After I filed my Appeal, they automatically sent me my notes. There was no need - at that time- to do so.

I received my nots aboout 2 1/2 months after I filed the Appeal (in 2010)

+1for that! Thank you very much. I actually do have a question, on the form 5744 where it says signature of spause or common-law does my husband need to sign even if he is the one being authorized?

I am not sure how the GCMS process works after filing an appeal. However, I know I have to order them if I want to see where things are at with my application.

I've read your posts gsize and I truly hope you and your significant other are reunited in the very near future. You have the patience of a Saint and are a VERY strong individual. All the best for a speedy reunion!

They send you a tribunal record, which typically includes your notes.

Last year after they refused my first application and I had filed an application for leave and judicial review in the Federal Court of Canada, I ordered a complete physical copy of my file, which included a copy of the CAIPS notes for my file - and was quite surprised to find things that had been removed for the tribunal record copy as well as added to the file AFTER I filed the leave application (including some communications that should have been redacted - the information should have been considered privileged.)

So they send you something, but it may vary from what shows up in the computer system. Also, note that back in 2010 they used two different systems (FOSS and CAIPS) and those have been replaced by GCMS.

No. That would be used if you were both signing it to give a third party permission to obtain your notes.

So do you think if gsize ordered the GCMS notes there could possibly be more information in them that she may not have been privvy to prior to and after her appeal?

thanks for your kind words. My parents taught me many important lessons in life, and one of them was to never give up no mattter how hard it is.

I can always walk with my head held high, not like SOME of the VO's that like to play with peoples lives !

It is certainly possible, yes. I'm not saying that there WILL be additional information, but I have seen things show up (like medicals for my second application showing up in my first application's file.)

In the end, you have to be willing to fight. CIC is an organization filled with people and - as they continue to increase the workload and decrease the staffing levels, the truly empathetic people will leave. That leaves people who view you not as human beings but as prospective undesirable elements who want to be in Canada.
