Hi there, a friend of mine is an international student, but his study permit and work permit were expired since last Aug.
he didn't re-apply his study permit within 90 days after the expiration date.
I know it has been for a while. I have no idea how this has happened. He now has a job in Canada, but he needs to finish his last course to graduate from university.
The things is he said he couldn't re-apply for study permit because it has been expired a long time ago.
He doesn't want to leave Canada without graduation. Is there any other way that he can restore his status as a visitor and re-apply study permit after that?
I know that his country has tourist visa-exempt to Canada. Please help!! Thanks a million.
The fact he's visa exempt makes no difference. It's too late for him to restore his status now.
He'll need to apply for a new student visa. If he applies from within Canada, I don't think there's much chance it will be approved, given he has overstayed and failed to follow the conditions of his previous visa.
I think his best option would be to return home and apply for a new student visa from there.
At this point it's not about what he wants or doesn't want to do. He's violated Canadian immigration rules, currently has no status in Canada and his options are limited.
