Hi Everyone!

My German boyfriend just got awarded a work and travel visa for one year and is coming to live with me very soon! We understand that this isn't a permanent fix to our problem and really don't want to get married this soon just because of immigration. Therefore, we are hoping to apply for family class sponsorship through either common law or conjugal partner. We are unsure since he is coming to live with me for a year which one to apply for.

I am not sure if I can sponsor him as common law until the year is entirely up or if I can start the process and submit it while he's here during that one year or if I should apply through the conjugal route (even though he is currently living with me so would that cause a hiccup?)

Any advice on how to best proceed so he can stay with me would be greatly appreciated :) He is coming in a couple of months and I would like to get started as soon as possible to avoid him having to return.

Thank you! :) <3

Conjugal is out. You have no barriers stopping either of you from living together.

You cannot start a common-law application until 1 year of cohabitation has been completed. So, after you have proof of a year of cohabitation, you can sponsor him in either Family or In Canada class.

Okay, so what you're saying is essentially.. he will have to go back after the year and then we start the process.
Since his visa expires after 1 year, I don't see how the "In Canada" thing would work?

And also, if one does have to return after a year... do you still qualify as common law if you break that cohabitation?

There is a class that permits someone to remain in Canada (and be eligible for a work permit after 4 mos) called the in Canada class. Essentially it's the same as FC, just affords people the option to remain in Canada.

FC used to be the fastest option, but as of late, the processing times are equalizing. With FC, he could apply (and reapply as required) for Visitor status to remain passed the end of his working holiday. Many have done this, and it does work for some. The catch is, he wouldn't be able to work. Unless he could extend his working holiday or get some other visa.

All you need is one continuous year somewhere in the world to qualify.

Thank you so much for your help!
You're the best :)

You bet. Best of luck.

One thing you can do to start preparing for the application is gather proof that you live together and are in a genuine relationship. For example, once he arrives, try to get his name added to the lease, to utility bills, etc. If he cannot be added to any utility bills, he can get a phone and have the bill come to your address. Get a joint account and joint credit cards - if one bank says no, try at others, even at other branches of the same bank.
You will need proof you lived together that covers one full year. You also need things that show your relationship is genuine, such as photos, trips taken together, messages and Facebook posts, whatever you have.
