FACTS:
- I'm British, wife is Canadian, 3 children.
- We're under 'old rules' (before July 2012).
- We lived in UK for 3 years consecutively on Spouse visa plus extension (FLR).
- We've been living in Canada for past 12 months, partly due to pregnancy and birth in May 2016, but would like to return to the UK.
PROBLEM:
Her UK visa (the extension) expires end of June 2016 - in 5 days!!!
1. Since we cannot return before it expires, will she have to reapply from Canada under the 'new rules'?
2. Can immigration show discretion and allow us to return and extend her 'old rules' visa within a month or so of the visa expiring? 3. Can it be extended at the border?
Apply for another extension online ASAP: http://www.cic.gc.ca/english/visit/extend-stay.asp As long as they receive it by the day her status expires, she will have implied status. (If what you're talking about is her status in Canada)
Edit: Wait, what exactly are your plans? Your post (and the fact that you're posting on a subforum for Canadian family class permanent residence) is a little confusing. Is she planning on staying in Canada past the day her status expires? If she exits and goes to the U.K. and tries to come back to Canada, she will basically be asking for status again, regardless of any extension or any "old rules", or are you asking about a visa that allows her to go to the U.K.?
