Hi All,

I am in canada on PGWP which is expiring in august 2024. My son is here with me on study permit whose Study visa (Permit as well as TRV) both expired on 6 April 2024. I have applied for my BOWP(as my PR is in process) and his study permit extension on April 4th 2024.

My question is can i apply for his TRV as we need to travel outside Canada before getting decision on his Study permit application. I understand my son is on implied status right now, so can i apply for TRV on this basis.

Thanks in advance, Appreciate your time and help
Sandeep

Hello,
yes, you can apply for a Temporary Resident Visa (TRV) for him. The TRV would allow your son to re-enter Canada as a temporary resident.

Since your son is currently on implied status, meaning he has applied for an extension of his study permit before its expiration and is awaiting a decision, he should generally be allowed to remain in Canada until a decision is made on his application. However, traveling outside Canada during this time may affect his implied status.
