My name is Mohammed. I am working as Designer in Canada.I applied CEC ON 22nd June 2013 got my AOR
I am from India and I want to get married to GF in pakistan. As everybody know how tough is India Pakistan visa can i do Phone Marriage as phone marriage is legal in pakistan and add my GF in CEC?By doing phone marriage my gf will get marriage certificate and they will send it here to sign it and then she can apply for new passport with my name.

I donot know how to proceed.I am thinking if i get my PR and want to sponser her waiting time is 24 months may be more.I donot want to wait as we already being engaged from 3 years.

So please tell me its TOUGH to prove Phone marriage authantic or not. I know peaple who did phone marriage from pakistan to sponser their wife to canada.

Seniours please help or any body who gone through same kind of situation
 
Here is an article by a lawyer on recognition of telephone marriages by CIC.

It says the marriage will not be recognized if you are in Canada when it is performed. However, you could be in a jurisdiction (such as Colorado, according to the article) where the marriage would be considered legal.


The article recommends consulting an immigration lawyer before attempting sponsorship through a telephone marriage.
 
As phone marriage is legal in pakistan so if i being in canada marry pakistani girl on phone, get marriage certificate and my name on her passport CIC WILL recognise it or not?

I'm not a senior member, but I will try to answer. If you are in Canada for the ceremony, then based on what the article says, no, it would not be recognized.

If you don't find a satisfactory answer here, I'd suggest you consult an immigration lawyer to explore your options.

I may have misread the article but doesn't it imply that the key thing is where the ceremony is being held (where the person officiating it is)? So if the ceremony is being held in Pakistan and the OP calls in from Canada, that could be recognized?

In any case, I agree that it is best to consult with an expert. It sound tricky anyway you look at it.

After re-reading the article, it does seem your interpretation is correct. It appears the marriage would be valid if the ceremony took place in Pakistan, even if the OP was in Canada. I withdraw what I wrote above, except that I still think it would be best to consult an immigration lawyer to head off any problems.

As per the instructions:

• Identity and civil status documents submitted must bear the name of the applicant, and be

responsible for registration.

From OP 2 Section 7

Telephone marriage A marriage in which one of the participants is not physically present and is
not represented by a proxy but participates directly by telephone is a legal
marriage if it is legally recognized according to the law of the place where it
occurred. This is a legal marriage for immigration purposes provided it
meets the Canadian federal requirements, with respect to consanguinity and
polygamy/bigamy.
