My husband is sponsoring me for PR under the family class, and we have a small problem.

Because of a delay with his taxes this year, we don't have a tax return form that is asked for on the application. I was wondering if it would be acceptable to send in a years worth of his payslips and then send his tax form in later? We have a letter from his employer and everything else, but not the tax form. He is panicking a little bit about this, and I seem to remember reading on here somewhere that someone sent in 12 months worth of payslips and then the tax form later on.

Any advice would be much appreciated.

If you cannot send the Option C form, as stated in the application package checklist, you can send a years worth of pay slips (photocopied). But you must include a letter explaining why. In my case I was working in the UK for the last year so this Option C printout doesn't exist for me as of yet. So I explained that in my letter and photocopied all my pay slips from the past year with my British company and I also sent them all my pay slips up to the date I submitted my application from my new Canadian employer.

In short, if you send them the photocopied pay slips for the past 12 months with a letter explaining the situation, you should be fine. Worst comes to worst they may ask you for that Option C printout tax thing (it's on the applicant checklist) at a later date but I wouldn't let this stop you from applying now. I was also told on this forum that there is no minimum yearly salary to sponsor your spouse so I guess they just want to see that he has actually been working and not on welfare/benefits.

Don't worry about this. It's mostly just a formality anyway. Unless you are totally destitute, a spousal application will never be refused for lack of income. Just make sure you include a letter of explanation.
 
Thanks Beshoo. We're going to send it a years worth of my hubby's payslips and a note explaining that we didn't have the tax return slip at the time of sending in the application. We'll tell them that if they still want it, to let us know and we'll send it in to them.
