Hi, my child is Canadian and was born in Canada when I was working. We returned back to our country and now she is 5 and i would prefer her starting school in Canada for a better education. My husband and I have no visa and are planning to apply for a visitor visa to accompany her to Canada but will have my brother, who has a work permit in Canada, become her legal guardian while I will travel back and forth most of the time. I wonder if I can get a visitors visa approved and if my child can study with domestic student fees since she is holds a Canadian passport.

Maybe. You have to show funds, strong ties to return to home country and travel history. Your brother cannot be her custodian in Canada because he is not a PR or citizen. Same with legal guardianship, not sure how that will work because he is on a work permit. He doesn’t have permanent status in Canada. Talk to an immigration lawyer about legalities. Your having a Canadian child will weaken your application as IRCC will think you will not leave. Maybe apply on your own without your husband. If refused, then make plans for brother to travel with her. She is eligible for domestic fees.
