What is a dependant visa? Who was a student first? When did you marry?

I came to Canada first (2022), and I still have one more semester to go. we got married in 2022.

So you both entered Canada as married and filed taxes as married. Still don’t know what a dependant visa is but if you mean a spouse open work permit, she can apply and see if approved. It is not guaranteed so she will not want to quit studying until approved.

So did you get your study permit as married, entered Canada as married and filed taxes as married. Same for her did she get a study permit and enter Canada as married. If so, she can apply for open work permit but doesn’t want to stop studying until her permit is approved. Because you only have a semester left and due to processing times, it is best to wait and apply with your PGWP application showing you have a job and paystubs.

If you got married in 2022 last year when you filed your taxes should have indicated that you were married to CRA. You need to contact CRA and change this. It tends to be more difficult to get a study permit if your spouse is already in Canada out of fear that people will get to Canada and stop studying which is why you are being asked if your spouse declared she was married on her study permit application? You normally have to have over 6 months left of your studies for your spouse to get approved for an SOWP so agree that your spouse should continue studying until you have a job (plus 3 pay stubs) and are applying or your PGWP to apply for the SOWP.
