Hi everyone!
I'm helping out a friend here. She is a student at the moment and her visa is going to expire at the end of the month. She has applied for post-graduation work permit. It is going to take more than her student visa expiration date. She is not sure at the moment if she can get the work permit with the school she attended but she tries it anyway.
Regardless this, she wants to stay in Canada after her visa expiration, if not for work than just to travel before going home to Brazil.
Can she get a visitor visa after her student visa even though she has a post-graduation work permit application in process?
Thank you for your help in advance!
Norbert
It sounds like she has applied for the PGWP while her study visa was still valid, so she is now on implied status. As she is on this, by law, she can work. There is sometimes an issue with employers not accepting this from what I have read on here, even though it is legal to work. I just gave my employer the evidence (screenshot, email and and email from the CIC stating that it was legal) to my employer and that worked. How long was her coourse?
Thanks for the reply but the question is if she can apply for a visitor visa while she is on the implied status. The reason is, that in case she gets denied for the post-grad work permit, she has to leave the country immediately. She has to go home, apply for visitor visa, wait until it gets accepted (or denied) and then come back to Canada. That what she is trying to avoid by having a tourist visa in case the post grad work permit is denied.
Please call an expert. An immigration consultant can advise you and file the paperwork for about $100. This is important. If she gets a visitor visa and then proceeds to work, there will be a lot of questions the next time she encounters the CIC or CBSA. If she fails to secure the work permit and has to return to Brazil. Even if she gets a visitor visa, she will not be allowed back into Canada because her intentions is to secure employment. Which is prohibited under a visitor visa. Again. Please speak to an immigration specialist. I know some of them are total rip offs. In most cases a single application only costs $100. I have helped a few refugees and students navigate the system, I've come across good immigration consultants and I've come across thieves that just steal people's money.
