Hi,

Quick question regarding visitor visa/status restoration..

I had a two year open work permit then went on to implied status whilst my PR app was being processed. The PR app was ultimately rejected so I now need to get a visitor visa.

My question is, do I need to restore my status OR just apply for a completely new visitor visa?

I’m currently living with my girlfriend in Canada.

If your two year open work permit has already expired, then you are out of status in Canada and need to apply to restore your status.

The confusing aspect of IMM5708e is it only gives me the option to restore my status as a visitor, but since I've never held a visitor visa before, I don't see how that's an appropriate choice. As I'm technically out of status right now, would I not need to get a new temporary resident permit?

Just to give you some more context to my situation, I lost my maintained status on August 10th, I have just recently gotten married and plan to submit a spousal sponsorship + open work permit app as soon as the marriage certificate comes through, which should be early December.

The right thing to do is restore your status to visitor. That's the option you should select.

A temporary resident permit (TRP) is something completely different. This is for individuals who are otherwise inadmissible to Canada typically due to a crime.
