Hello,
I am a partner of a PR applicant through the AIP Program. We are waiting for her job offer and endorsement to start filling out all the forms, and I have encountered a problem.
We are a couple that met in Ireland in 2020 while on student visas. I was deregistered from school in February 2020 and was ready to leave the country because of that. Then COVID-19 came, and I got stranded in Ireland. Due to the restrictions and lack of information, I stayed there for two years until I got my COVID-19 vaccine and then left on my own will, with no deportation or any contact from immigration during those two years in breach of visa conditions.
Now, when I requested my Police Certificate, they obviously mentioned my overstay. I have already thought about a Letter of Explanation (LOE) with a timeline, canceled flight details due to the COVID-19 outbreak, the relationship motive, and an overview of the COVID-19 situation in my country to justify my overstay. However, during those two years out of status, I never contacted Immigration, fearing that they would send me home without a vaccine or the chance to be with my partner.
Now, she has a job offer in Canada, and we have a one-year-old child, aiming to move together. I am concerned that this might be a red flag in my profile. Could this have a significant impact on her application? Can her application for PR/Work Permit be denied because of my visa situation in Ireland?
I am seeking advice from anyone who might have experienced a similar situation, as this is really upsetting me. The anxiety of potentially jeopardizing her application (and our family's chance to move to Canada) is overwhelming.
