My brother wants to sponsor his gf who just recently divorced her husband back home.
If she comes here on a visitor visa, do we have to mention that my brother is in a relationship with her (since 2008) or state her as being Single?
They've never lived together and not married but he did went home to visit her recently for 2 months.
I can send her the invitation letter so she qualifies for visa but we want to make sure later, that we can say he's been in a relationship with her when we apply for her PR/sponsorship.
They wanted to marry back home on his visit but her husband at the time refused to finalize the divorce.
They plan to marry when she's in Canada while on visa.
If they're not married and they haven't lived together for a year, they'd have to apply as conjugal partners. For that, they have to prove that they've been living in a marriage-like arrangement for at least one year, even though they've been living apart.
They need evidence like shared finances, interdependence, frequent communication, showing that they have presented themselves as a couple to friends and/or family, that sort of thing. From your description, it doesn't sound like they've been in a conjugal (marriage-like) relationship for more than one year.
So, her coming here on a visit and then getting married sounds like a plan. Right now, it doesn't sound like they're in anything that counts as a relationship for immigration purposes, so I think it's fine to say that she is single, because that's what she is.
better if she doesn't mention that they plan to get marry..
but last year i was visiting my boyfriend (but i didnt need visitor's visa, only biometric passport), so when i landed in Canada, i said that i am visiting my boyfriend. the official just asked some questions about my boyfriend, making sure if i know him well.
