Hi. I'm a PR since 1999. I'm applying to sponsor my husband & we are confuse as how to proceed.
He (Australian) arrived Canada in 05/2005 on a one year work holiday visa. We met a few weeks after his arrival and our relationship started. He had to leave 01/2006 back to Australia for his brother funeral, coming back to Canada on 06/2006 on a visitor visa. He was living on a rented room back then in a big house belonging to the friend of a friend. On 02/2007 he left for Finland for a month, coming back to Canada 03/2007. By then he was almost living with me, his personal items divided between his room and my house. Mid March the house where he had this room got busted and he was charged with growing pot which the police found in an outbuilding on the property. He had nothing to do with this but as he was in his room in the house at the moment the police arrived and he was the one charged. He moved to my house fully after this and we have been living together since. He was on bail from 03/2007 untill 06/2009 when the sentence was final. He was found not responsible for the grow-op and he got a "conditional discharge", probation for 2 years and 100 hours community service. I've been supporting him all this time as he has not been able to work (no work permit), he has been extending his visitor visa since 3/2007. The last one has a note that "not further extension will be granted until sponsorship app is filed".
After all this time, his life is here in Canada with me. While on bail, his passport was removed and he was not allowed to leave Canada. We are now married and are applying for spouse sponsorship.
First we completed the Inside Canada app but now he has the opportunity to work in Europe for the month of October. Since the sentencing he has been allowed to leave Canada with permission of his parole officer, which he has granted. After all this time, he needs to work and has the opportunity to do so in October and Feb next year. Now, after talking to the CIC a few times they told us to use the Outside Canada App as if he leaves Canada after sending the Inside Canada app, it could not be approved and appealing doesn't apply.
Now, we are not sure what address to use as he is intending to re-enter Canada after the Europe trip in October under a visitor visa again. I'm meeting him half way on his trip so we can come back together on the same plane. He considers Canada his "permanent residence" (even though he has no PR status) we could use his mother's address in Australia or his brother's in London, would this mean he has to go to Australia/London for the interview if there is one? Do we send the Outside Canada app forms (both sponsor/app for PR) directly to Mississagua? Can we use my home address here in Canada as his address as he doesn't have a home elsewhere?
Regarding his problem with the law, I believe the sentence of "criminal discharge" means no criminal record. Do you have any idea if this would be consider him as inadmissible? There was a Canada Border Enforcement Officer at the sentencing, he was very nice and told us after hearing what the judge had to say, he was closing the file on him. He advise to attach the final sentencing transcript to the PR app & explain what happen.
