Hello,
My husband got his PR last year 2013. I missed the PR date dut to health reason. Now i want to apply for the PR. Both of us are in USA

My questions:
Can i reopen my case?
Can my husband sponser me now even he is outside Canada or he has to go Cananda to sponser me?
How much time it will take to process my case?
Shall i go on visitor visa with my husband and then apply for PR ?

Can you explain what you mean by "I missed the PR due date due to health reasons"? Are you saying that your PR visa was issued but you didn't land in time?

Since your husband is a PR, he must be living in Canada in order to sponsor you and must continue living in Canada while the application is being process (until your application is finalized). So no - unfortunately he can't sponsor you from the US.
 
Thanks for the answer. Yes I didnt land on my PR visa date. SO can i request the Embassy to consider my case and reopen it or i have to apply again?

If you already landed before the expiration date on your COPR then you are a PR as well, so what makes you think you are not?

You have to apply again. You can either apply for PR independently (e.g. as a skilled worker) or your husband can sponsor you provided he is living in Canada.
 
My apologies, I read that as "I DID land on my PR visa date" ....

I don't know what your health issues were, but keep in mind your PR application can be refused if you fail the medical exam. Was it just a simple injury or something more serious? (don't have to answer my question of course, its private).
 
I would first try to see if the visa office would consider re-opening your file. Health reasons are extenuating circumstances and if you have medical records to support your claim, it's good to try this route first.

I would contact your visa office and explain clearly what happened. Attach your medical records as proof and kindly ask them to consider re-opening your case. If you are lucky, they may re-open the file, ask you to redo medicals and re-issue the PR visa. There is no guarantee it will go this way(since you waited too long to ask) but there is no harm in trying. Do let us know how it goes if you decide to do this.

1. The Visa office won't re-open. As above the spouse has to return to Canada, and sponsor her as his spouse. New Medicals, new PCCs. new fees.
