Hello everyone!

I am awaiting my marriage certificate (got married on Saturday :)). Meanwhile, I wanted to ask a couple of things:

a. Can you give me a detailed list of evidence you attached? We have the entire timeline of our relationship on our facebook, Instagram, and Twitter. We also have emails from our friends congratulating us on our elopement and a formal wedding announcement we made on our facebook. We have plenty of pictures etc, too.

b. My TRV expires on May 5th. Where should I send my request for extension of stay? CPP-Ottawa or with my PR application?

c. Any advise/common errors people usually make that I should be aware of?

Thank you so much! This forum has been a GREAT help for me.

Best,
A

Hi, you can extend your Visitors Visa online 30 days before it will expire. Are you applying Inside(inland application or Outland/ outside Canada. That is one of the things you will decide. Yes, gather all the documents from the time you met till the present, wedding photos, letters from families that your marriage is genuine and continous, facebook, twitter, instagram, wedding invitation. If both of your parents and his/her parents were not present during your wedding made a brief, straight forward reason.

Gather more proofs about the your relationship. Quality over quantity.

Congrats on your marriage!

Anything you can send showing you have combined your lives is good. Copy of home/car insurance policy listing both of you on the policy. Statement from joint bank account. Copy of a lease/mortgage in both of your names. Life insurance listing your partner as beneficiary.

We didn't send a lot (we were pretty clueless with a capital "C" at the beginning of this process). We included 8 photos with information on where each was taken (one from each of our two vacations abroad, one from a formal event attended by his whole family, one from our American Thanksgiving with my family, one from our Canadian Thanksgiving with his family, one from the small, informal courthouse wedding, and a couple of others). For the photos, we posted them in colour in our "relationship narrative," where we told when we met, when we traveled together, when we first met each other's families, why we were married in such a small ceremony with no family present, etc. We also included travel itineraries listing both of our names for the two times we traveled outside of the U.S. together.

I don't know much about the TRV, because I'm American and was visa-exempt. Where are you from? I'm thinking you may be American, as well, since you listed CPP Ottawa. If so, you can request an extension of your visitor status online. I applied for and received a one-year extension to my visitor status online, stating I wished to continue to stay with my husband while my PR application was processed.

As for advice, read the instruction document carefully. Then reread it. Then reread it. Then, once everything is gathered and organized and ready to go, read it again! :-D We made a lot of mistakes, but thanks to this forum, we were able to correct them before they could derail my application process. One thing that is helpful to know is that your medical exam is only valid for one year from the date of the exam. This means you want to schedule the exam as close as possible to the time when you expect to be ready to send your application to reduce the risk of having to redo the medical due to its expiration. Also, the police certificate (FBI record check, if you're American) MUST be received by CIC within three months of the date it is issued, so you don't want to order it too early. You'll need to look at the expected timeline for police certificate processing for your country, and then try to time the request so that you receive the certificate not long before you plan to send off your application packet.

I'm applying inland. Both of us have been married before so this time around it was a small wedding and the families don't approve but we did have one family member, my husband's youngest brother, who was present at the ceremony. We do have a small reception coming up but that's less than 15 people, again.

I'll reply in a list:

1. I am from Pakistan but haven't been there since summer 2011. Between 2007 and today, I was studying in BC, then the US, Ireland, and the UK. I came here to visit (i had plans to work in the US) but my now husband proposed me the day before I was supposed to leave. Mainly because long-distance doesn't work for us. I have a visitor visa and I have UK residency (my ex-husband was British). Should I attach my letter from the UKBA where they confirmed my residency? I never sent my passport to them because I had already filed for divorce by the time it went through.

2. What did you say about your small ceremony? For us, both of us are atheists but our families are Muslims. We wanted nothing to do with religion (we had religious ceremonies with our previous spouses). A straight, secular, civil ceremony with a humanist celebrant is what we wanted and that's what we did. Our families don't approve of the marriage at all. They wanted both of us to go the arranged marriage route which we tried to talk them out of but failed so we had no choice but to elope.

3. I already have my FBI clearance (applied right after he proposed to me!) and I am getting my clearance from Pakistan in the next week or so.

4. We have travel records for when I was in the US. He visited me 3 times last year. I visited once before moving here. I do have pictures with his family since we are family friends. The families are just against the marriage not because they think we are bad people, just because they wanted us to marry people they had picked for us in Pakistan. Nooooot gonna fly, haha. Plus, they don't like how we both are atheists and support each other's secular activism (both of us are writers and speakers on various human rights & first amendment issues).

Any tips? :)

Oh, I have another question! I'm trying to get my marriage certificate sooner but IN CASE it doesn't come in time, should I still apply for my visa extension by April 4th even if I have not yet submitted my PR application? Pls let me know!
Also, what should I put in "how long you wish to stay" category? Should I just put one year and then explain that I am waiting for my PR to go through?

1. I don't know anything about all of that except that I would think you can still apply to extend your TRV online: http://www.cic.gc.ca/english/visit/extend-stay.asp. You are supposed to apply at least 30 days prior to the expiration of your current status. As I said, because we had already submitted an inland PR application, I asked for an received a one-year extension to allow me to remain with my husband while my PR app was being processed. Not sure if you will have sent in your PR application yet by the time you need to apply for an extension? If not, my advice is to pay the fees (at least the sponsorship - $75 - and principal applicant - $475 - fees, even better if you can pay the right of permanent residency fee - $490 - up front as well) and include those receipts with your extension request to show them you will be submitting an inland application.

2. As I said, we submitted a "relationship narrative" to give more info and more fully answer questions from form IMM 5285. It was about four pages long, including the colour photos within the document, and I put a header with the form number on each page and placed it behind the IMM 5285 form. In this narrative, explain what you've explained to us here. You are both atheists from muslim families. Your families are aware of your relationship but, due to religious differences, did not support you or attend the wedding. Share what you shared here, that what was important to you and your spouse and consistent with YOUR beliefs was a secular humanist celebration of your union, which is what you got. All of that makes sense and explains why the ceremony was small, was not traditional, and did not include your families (with the one exception). For us, we explained that we simply weren't concerned about the ceremony. We wanted to get married, not have a wedding, especially since he's military and we never could have had a ceremony that would have included all of our friends and loved ones, since they're spread across the globe. So we simply had a legal ceremony at the courthouse and, instead of family (mine lived just over an hour away, his over 3000km away), we invited three friends who lived or worked nearby to serve as witnesses.

3. Just keep in mind that CIC must receive your app, containing your FBI clearance (and everything else, of course, haha) within three months of the date the FBI issued the form. If not, it's NOT the end of the world. Include the FBI clearance you have now and a note stating that a new one will be provided. Since you already have a TRV, you already have your UCI number. When you get the new FBI clearance, send it to (Mississauga? I think inland apps now go there, instead of Vegreville "back in my day") with a cover letter noting your UCI so they can match it to your file.

4. Include the travel records, to show you doing things you did as a couple. And include the photos. You'll be explaining why your families don't support the union, but photos show that your families are aware of the relationship.

Extra question: see what I said about paying fees for PR application prior to requesting the extension. Not absolutely necessary, but helps show CIC you're serious and you're getting things together to apply soon.

The fact that you got UK residency by marriage to a British citizen and now being sponsored by a Canadian citizen may be a red flag. An officer could question the genuineness of your relationship. It is therefore important to explain about the previous marriage as clearly as possible when you apply.

Thank you both!

Btw, since I did not send my passport and don't have the UK residency stamp on it, I can just leave out that piece of information altogether.

Be very careful about "just leaving out" information. Omission of pertinent information can be grounds for misrepresentation.

Not sure which province you got married in , but here in Ontario it takes 12 weeks to receive your marriage certificate . I tried even with a letter saying it was for immigration and needed asap . 12 weeks and still waiting .

It is not misrepresentation as right after I received my residency approval, I re-reminded UKBA that I have filed for the divorce & do not intend to send my passport to them. I had the approval, I never accepted the offer.

It was ON but the office has been very nice to me. We've been faxing & calling them regularly :)

CIC will run backgrounds checks on you anyway and are likely to find out you were approved. About not sending your passport - does that automatically cancel your UK residency approval?

You may want to look into that because it is possible you are still in the UK database as having "indefinite leave to remain"(their equivalent of permanent residence).

Anyway, as long as you are truthful in your application, there should be no issues.

Yes, I know but I will mention that I did plan to continue the marriage but despite my best intentions, it did not work out. I will mention those reasons as they are also referenced in private chats & emails I have with my current husband.
And, yes. It does cancel it out because I never sent my passport for the stamp. I don't think it will be an issue, to be frank.
