Hi All,
I am applying for my wife's Spouse PR Inland, My wife landed Canada in June 2018 and her visitor visa 6 month will be completed in December 2018. So once I apply for her PR in the month of October 2018 which would take approximately 8-9 months for CIC to reply,
My Question is that will she have to leave Canada after December 2018 once her visitor visa 6 month duration is over even though I have applied Spouse PR for her. I will also be applying for her open work permit..
If there is no reply for her PR and OWPermit from CIC until december 2018, will she have to leave canada in this case?
Regards-
She will have implied status because of the owp but of the app is returned for any reason after december she will be out of status and you will have to apply to restore her status before you reapply for the owp.
To set expectations - ircc promises to complete 80% of applications within 12 months. Dont bank on 8-9 months as every application is unique
Like the previous poster said, she will have implied status which is used to bridge the gap between visas+ pr approval.
If it gets returned for eg. paperwork incomplete or signatures are missing, implied status won't be there and she would have to rely on a visitor's visa to stay.
It's for this reason usually applying sooner rather than later is best, because if her visitor visa expires, you'll need to have it reinstated and that takes forever (and you can't reapply without a visa or permit allowing you to stay in canada).
If you are concerned about the package being returned, include an application for a visa extension.
Apply for a visitor extension. It serves as your insurance if OWP gets returned.

A person with no status in Canada can apply for sponsorship. They won't qualify for the OWP.
A visitor extension app can't be included with the PR app. It must be applied for separately.
