Hi, I would appreciate some advice from the the seniors here!

My spouse is on 1 year open work permit and his current employer would like him to stay longer. We do not have an LMO since his open work permit is based on me being a foreign student in Toronto.

My question is, can we still apply to the Federal Skilled Worker program under Arranged Employment?

CIC webpage says that they accept if one holds an LMO exempt job under an international agreement (such as, the North America Free Trade Agreement) or a federal-provincial agreement - which is not our case at all.

Should we then get his employer to apply for an LMO?

We can't go down the PNP route as my spouse's company is in business for less than 3 years. A huge bummer.

You need an approved LMO to apply for FSW under arranged employment.

Yes - your spouse's employer needs to obtain an LMO if you want to apply.
