Hi, I am planning to exclude my spouse from my immigration application since he refused to accompanying with me and refused to provide any documents to support my application. I am afraid of being stuck for being asked for the security check and ME later for him. Because I know he won't do that. As I know, if he failed to pass the security check and ME also lead to my application get refused. He told me he can make a notarized declaration for not being sponsored by me now and in the future. please help me, is this declaration useful to get him not examined?
my understanding is that I tried my best to convince him to come with me, but he won't come for sure. Our relationship have been last for 40 years, we both don't want to end our relationship. If we both make a declaration, why we still need divorce?
CIC need to know about any marriage in the past so they are definitely going to want to know about this one, a declaration won't work as like stated before any lawyer can argue and win that you can get back together/had no intention of really splitting. You have to be either divorced or legally separated to not include him, if neither one of you wants to be in the relationship then there should be no reason why you would want to still be married.
