I was looking at processing times for sponsoring your spouse who lives "outside" of canada. What I noticed was there was still canada in the list where it says "where are you applying from, the processing time as 12 months". Does this mean this for spouses that live "in" canada? How would someone apply from canada if the spouse is living "outside" of canada?
the short answer is that a person can't apply "in canada" when they are not physically present in canada. however, a person can certainly apply "outside canada" when physically present in canada.
there are 2 streams for spousal sponsorship - outland and inland.
a person can apply outland (outside of canada) no matter where in the world they are - even Canada. it's quite common for people to apply "outside of canada" when they are in canada as a worker, student or visitor. there is no rule that says a person can not apply outland when in canada. this is actually the recommended application to use by CIC so the applicant can take advantage of the quicker processing times.
A person can only apply inland (in canada class) when they are physically present in Canada and will be for the duration of the application. the in canada class application requires the applicant to be in canada then entire time. a person can not apply from within canada if they are not physically present inside canada.
You don't apply from or to the Indian visa office. You send your application package to Mississauga and they choose where to send your file for processing - in your case that would most likely be India.
