Hi there,

Looking for some clarity. My common-law partner and I are currently living and working in Canada. She is on an IEC open work permit which is vaild until November 2018 and I am on a LMIA visa which expires within the next month.

My common-law partner is currently employed in a skilled position (Class B) whilst on her IEC open work permit. Her visa and job is good until November 2018, 8 months from now.

My question is would I be eligible for a spousal open work permit in our situation?

Any information on this would be awesome as I am a little confused with the wording (specifically, if she is classed as having a Temporary Resident Visa, while on her IEC Open Work Permit)

Hi

Yes, you can apply for a work permit based on your common-law partner's status.

Unlikely that she has a TRV but it wouldn't matter if she did anyways. A TRV has nothing to do with status in Canada.
