Sponsorship Rejected

Hi Folks, hope you are all doing well.

I recently got our second set of GCMS notes and found out that my wife has been rejected as a sponsor as she failed to declare me as a non accompanying spouse on landing in Canada.

When her PR was granted, she was single, but got married a month before landing in Canada. As a result, her COPR showed her status as single and unfortunately she signed for it wihtout properly checking it.

Subsequently we were sent a mail on the 4th of January regarding this, but never actually received the mail. We contacted CIC on numerous occasions thru call center and also via webform, but the never disclosed the contents of this letter. The application is now at New Delhi VO.

At present, my question is if we withdraw the sponsorship application, can i then apply for a PR myself? And also does my wife have to worry about her PR status, due to non-disclosure. The section she has been rejected is R117 (9)(d).

Any insight would be greatly appreciated.

Do you have a CRS score of over 440? Yes you can apply by yourself. Yes your wife did misrepresent her marriage status but she can update her file and apologize for the error and she will likely be fine.

Ah ok, cheers for that. Would she just update CIC through a webform yeah or yu reckon calling is better? Regarding my CRS, if i get the same score in IELTS as i did a few years back, i'll be slightly above 440 by my estimation.

I would send in a CSE informing CIC that you made an error not declaring your husband and realize you can't sponsor him but wanted to update your file.

There is no point in her sending a CSE. IRCC is already well aware that she failed to declare you and she cannot update her already closed file. They are unlikely to take action against her for this misrepresentation.

True. Forgot that they already knew from the GCMS. You seem be in a lucky position that you qualify on your own. Most are notes lucky

Side note: does this make a difference at all with a sponsorship application? My husband scores in the 480 range, and I am worried about immigration not accepting our plans to move back to Canada and initially rejecting the application.

CRS scores are irrelevant to sponsorship apps.

No idea what you are asking. If a person has a high enough CRS, they can apply for EE; qualifying does not require a job offer. If they have a Canadian citizen/PR spouse, they can apply for sponsorship. The 2 options have nothing to do with each other.

Just spoke to an immigration consultant and can confirm that a job offer isn't necessary, but having an offer adds a lot of points to the CRS score. They also told me 440 and above is a good score, but did warn me that the latest draw had a cut off of 454 on the CRS scale.

Yes - a job offer adds 50 points to your score. Note that for something to count as a job offer, you generally need an approved LMIA from the employer in addition to the job offer itself.
