Hi, im chilean citizen my wife is canadian citizen, we already applied last year for my permanent resident. I was wondering im i allowed to stay inside the country to wait for my answer or do i have to go back to chile. Currently i have a working permit expiring on july 18th, should i renew it as a visitor visa or should i just go back to my home country. She send the sponsorship as outside of canada, because at the moment of sending the application i was until in Chile.
you should apply for a change of status, and you should do it NOW!! as it needs to be done before your current work permit expires.
You can go back to Chile if you want, but if you prefer to stay in Canada, then apply for a change of status before the 18th of July. You will not get an answer before the work permit expires, but if you apply before the 18th of July, you will be under implied status, which means that you can stay in Canada until you receive the answer about your visitor visa from CIC. Then - if your visitor visa is approved, you can stay. If not, you have to leave.
here is the link, have a look and find the forms that correspond to your situation http://www.cic.gc.ca/english/information/applications/guides/5551ETOC.asp
if your work permit is extendable, you can apply for that. If it's not, then you should apply to get it changed to a visitor status.
Good luck,
Sweden
Thank you so much sweeden, but i also have another problem, apparently the officer when i got inside canada made a mistake on my work permit, she corrected it but just wrote on top that my permit is valid until the eighteen but on the other side of my permit says that i have to leave before july 2nd so im really confused right now. My forms are ready to be sent online, but my problem is that i dont know is right now should i apply to restoration of status or just extension. Do you think that i should contact them or try to go to an office. Is it really complicated that they approve my restoration with a permanent residency being processed. Also on the online application i have the chance to write a letter of explanation should i explain them my situation and apply for extension, since my permit says is valid until the 18th. Im really really confused right now.
