Hey guys,

I have a question. There's a woman who migrated to Canada with her family. She has a daughter from another man from a previous relationship before she met her current husband. The husband didn't want her to declare the daughter as part of the family because of fear that her biological father will try to use her to get to Canada. It's been 14 years, the woman misses her daughter. The daughter is now in her early 30s. She wants to bring her daughter to Canada but is unable to because she's not declared as family. Is there a way for her to get her daughter to Canada? She fears that because she didn't declare her as her daughter, she might get deported if she took action. What should she do?

By failing to declare her daughter in her own PR application, she committed misrepresentation, which could lead to revoking her PR.

Since the daughter is now far too old to be sponsored, even if it were possible for her, I don't know what, if any, action CIC would take at this point.

Daughter is too old anyways even if she was declared on the application. For declared children you can only launch a family class app for them up to age 18. If Liberals raise the age it will be only up to age 21.

She will need to find a way to qualify independently if she wants to immigrate to Canada. There is no chance through family sponsorship.

Yes, as stated, but 14 years ago she would have been eligible.

As stated above, the daughter cannot be sponsored in any case because she is too old. That is, even if she had been declared on the original application, she is too old now to be sponsored.

So to avoid problems with the mother's PR, I would not try to sponsor the daughter. The application would have no chance of success, and it might cause problems for the mother.

However, the mother and her family could look at the other ways to immigrate to Canada. The daughter may already be qualified under one of the other streams. If not, the family could perhaps help her gain the education or experience needed for one of the other streams.
