I have a friend who came to Canada on visitor visa, she married a Canadian citizen and got her status as being 'Immigrant' - after living with her spouse for 10 years, they decided to get divorce which they eventually did. She had her boyfriend back in her home country and now she wants to marry him and call him to Canada. What are the questions she needs to get prepared for - as far as immigration is concerned? She has decided to file on her own, instead of availing or hiring an immigration lawyer for this.
i'm confused. is your friend a PR (permanent resident) or citizen of Canada? Legally, it has to be one or the other. An immigrant is not a legal term to describe residency, i would think - it's a general term for anyone migrating to canada from another country. If she's a PR, when did she become a PR? There are rules for how long a person needs to have status as a PR before being able to sponsor someone else. Also, what is her "home country", where her boyfriend is from?
More information is needed before anyone can give you legitimate advice...
If she is a Canadian Citizen she can sponsor her boyfriend and can live outside Canada with her boyfriend if she wishes. If she is a permanent resident she must remain in Canada to sponsor her boyfriend. She also must have completed her stay in Canada to be able to sponsor him.So have she lived in Canada the last 10 years or have she lived outside of Canada. At this point she does not need a lawyer this forum and the very nice ,and well informed people will help her.
Thank you so much for your replies !! truely appreciate it !! coming back to your questions - she is a canadian citizen and has lived in Canada for more than 10 years now, she is from the caribbean islands. your further advice on this post would be of immense help !!
