SPONSORING PARENTS (2014) : MNI/LICO Question URGENT

Hi

I sponsored my parents in 2014 January and my application got accepted as part of the 5000 intake. Recently I got a letter from CPC Mississauga saying, my MNI for the year 2010 is not sufficient (note that I had to submit 3 prior years NOA 2010, 2011, 2012).

The problem is I started working fulltime in 2010 July. So my yearly income for 2010 was lower than the expected. However the application got transferred to the colombo, Srilanka visa office.

I submitted a letter explaining that I started my fulltime work in 2010, and that is the reason for the low income that year. I also submitted from 2013 - 2016 NOA which is well above the required MNI/LICO.

Has anyone experienced similar scenarios? Please advise me because I am very nervous as to what will happen next. Will the Visa officer consider my last 3 years (2013-2016) NOA as a valid income proof to support my parents?

Unfortunately you should be expecting a refusal. You should expect the visa office will eventually send you a letter stating you don't meet the income requirements for 2010 - and providing you the opportunity to prove that you do in fact meet the income requirements for this year. That will be followed by a refusal. You have to qualify at the time you submit your application.

when you say, provide an opportunity to prove the income for this year. I did that by sending all my Notice of Assessments for years 2013-2016. Will they not consider?

A strict condition to be eligible to submit PGP app in 2014, was to provide income meeting LICO for tax year 2010. Since you didn't have sufficient income in 2010, you were not eligible to apply in 2014. You should have waited until 2015.

In most cases income qualify is a yes or no answer, there should be no discretion allowed by a visa officer to consider anything else.

Most likely they will not re-consider anything and you will eventually get rejection notice. If this happens, you will have to try again under new lottery system in 2018.

I dont know why you would send in the app despite not meeting the income requirement, because you took the spot of someone who could've met their income requirements
