Can someone please help me out? I just failed the ADR interview today. And I’m waiting for a full hearing on April 12, 2010. I’m just scare I might fail the full hearing also, is there anyway I can re-apply to sponsor him again in the future. Is there a chance my husband and I can win the case and be together? Because if we can’t win the full hearing case and re-apply to sponsor him again. My husband and I will live together in Cambodia.
If I fail, can I re-apply in another 2 or 3 years after we live together?
Please help me out.



December 2007 - filed
November 2008 - interview failed
February 2010 - ADR failed (she failed me before the interview, wanted to speak with my husband)
April 2010 – waiting for a full hearing
 
I wish you luck but I don't really know much about the appeal processes. You should get legal advice. If you do move to your husband, there would be nothing preventing you from applying to sponsor him again after a while.

2nd Sponsorship after refusal and losing appeal, the OP should google Res Judicata . If there is no "new" evidence and it has to be compelling, then if the application is refused again, it won't go to appeal, as under Res Judicata, the matter has already been decided.

Wouldn't it be compelling new evidence if, as OP says she is planning, that they would live together in Cambodia for 2-3 years before applying again?

Not usually. The OP should go to http://www.canlii.org/en/ca/irb/index.html and search on the text Res Judicata and sponsorship. As it would be post refusal appeal
