I am a Canadian, born and raised, currently looking to sponsor my wife who is originally from Indonesia. She has lived here 7 years, finished school using a study permit, and has since switched to an open working permit. We got married 2.5 years ago in Indonesia (we have Indonesian marriage documents, not Canadian) and have lived together in Canada for the entire time. My wife's working permit is set to expire in May 2014 and she has just recently become unemployed. I am not sure if this matters or not.
Because, my spouse has studied and worked here she could apply through the skilled trade PR or Canadian Economic Class PR. We are confused as to which path is the best for her.
My question is this: Which path should we take to obtain her PR?
Any assistance in this matter would be greatly appreciated. Let me know if additional information is required.
Do you know for sure that she qualifies for Canadian Experience Class? If so, then I would vote that she apply for CEC since she will qualify for BOWP (bridging open work permit) after the application has been accepted (I believe this takes around three months). So if she applies for CEC now this will give her plenty of time to get the BOWP before her open work permit expires.
I went and double checked the eligibility requirements for the CEC and my wife's profession is NOT being considered. So I guess the CEC is not an option after all.
She has a diploma in accounting. So based on that education level, she only qualifies as a technician and has only had work experience at that level so far.
OK - so based on that the Federal Skilled Worker program is out too.
So your options are sponsoring her as your spouse using the inland or outland method - or it might be possible for her to apply through the provincial nominee program (depending which province you are located in and if she qualifies).
Right now it's looking like spousal sponsorship may be your only option. The choice will be between applying inland or outland.
If you want to sponsor her a family class application will work. You won't need to deal with the other two options. If you file one inland and also file a new owp with your family class application and her current work permit is indeed a standard open permit and not like pgwp or something else similar, she will be in implied status and would be able to continue working. If you chose outland application there would be no implied status.
There are a couple options available to you that don't require her to qualify alone.
