I read that if you were single but in fact married you can never get your spouse since you did not declare them. In this case can i sponsor my girlfriend as common law partner since we already have a son?
Do you meet the requirements of common law (living together in a mutually exclusive relationship)? Having a child doesn’t necessarily mean you meet the common law definition.

You'll need to provide us with the full details of your case.
Did you land on a PR visa that said you were single when you were in fact married? If so, you can never sponsor your partner - either as your spouse or common law partner.
If that's not what happened, you'll need to provide more details.

The reason why he did not declare her spouse is because after marrying her on 2002 (secret marriage) she went to Japan and since then for a long period of time they don't have any communication at all and found out accidentally from one of her friend that she got married and had two kids already to a Japanese man.

To be honest with you, I cannot connect the dots between your two posts. He, I, They, She, are any of those relevant to the title of your thread? So confused.
