Hi hello! I need you help? Can i sponsor my common-law if she still married in the Philippines. She just file the annulment last June 2014. We are already have a two child and they canadian citizen. She been working as TFW since 2008-2014. Now she is already in the Philippines beacuse her contract is already done.In canada revenue we are already as common-law since February 26, 2012 until now. We have a pictures, travel together her, bank account, bills, and we have house rent to own with name of me and her. And we still communicate to each other to social network site, emails and remmitance. If possible the CIC can be refuse my application? Please help me and thank you guys!!

Yes, you can sponsor her as your common-law partner even though she is still married to someone else.

You need to file under outland application that pertains to the country that you wife lives in . Go on the cic website and type in sponsorship common law partner and apply outland. May be some one can post the link for you .

Hi guys our application for common law sponsorship is already send this march 2015, but I'm very confused to our application if they going to deny/refused. I just read the forum about the refuse the sponsorship of common law. I'm so worried. My situition is before I apply for permanent residence my marital status is single I did not change my marital as a common law in application to PR until I get my PR on June 2012.In CRA we declare as common law since my daughter was born on Feb. 22, 2012. We live in together when my daughter was born. Then in our application we put that date when we live in together. My question is there anything possible taht can be deny/refuse in our family sponsorship application for not declare as a common law in my PR application?

Yes. CRA's definition of common-law is specific to CRA. By CIC's definition, you did not become common-law until Feb 2013, so you were still considered single when you became a PR in June 2012.

thank you guys i just got AOR this morning our application receive 3/25/2015.

Hi guys my sponsor application was approved last may 28, 2015, and for permanent resident application it was sent already in VOM. But my common law partner she worried about her application in the Philippines. Her IMM 0008 we put the marital status is common law but she still married right and her annulment is on process. And also about the previous spouse/common law question in there? Is there any problem to her application in the Philippines? She very worry to her application if immigration is going to refused her application.. You know I'm miss my two children and my common law partner

Did she admit she was still married, and was trying to get the marriage annulled in the application? She is common law, with you, so that is correct for her marital status. She should have put down her husband's information for the previous spouse question
If something is not quite right in the forms, but all the information is there, the visa officer should be able to figure it out. This kind of situation is common in the Philippines.
I would expect the visa officer to be questioning her about when exactly you started living together. Make sure she is clear that it was in Feb. 2012.
