Hi,
We (Me,wife and 2kids) got PR in May 2014 and went back within 50 days after getting PR. Now i (only me) just came ere in canada july 2018 and want to sponsor one new born (as baby is in Pakistan now with family). In july 2019 my & my family PR will be expired and i want to bring my baby here with family. My questions are;
- Should i apply for visit visa for my new born to bring all family togather at once or
- should i apply direct sponsorship from canada for my new born (like this it will take time and my family can stcuk and their PR will be expired if they wait for new born immigration.
-Third v important.. we all family member who have PR could not fulfill residency obligation as 730 days in last five years,, till expiry as july 2019.

What should I do now??

Thank you v much for immediate response..

Best regards
MUK

It doesn't sound like you meet the residency requirement at this time. Based on the dates you provided, you have spent more than three years outside of Canada in the last five. You cannot sponsor your new baby until you meet the residency requirement. So if you returned in July 2018 - you'll need to wait until July 2020 before you meet RO and can sponsor your non-PR child.

hi there, you can live with expired card (within Canada) then meet the residency requirement to renew. Otherwise, you cannot go back to Canada with the expired pr card if you travel outside canada.

PR cards just a transit card. You can live in Canada without the card but you will need the card to get into the country. You were lucky and weren't reported when you entered Canada without meeting your RO. The rest of your family aren't meeting their RO so they could be reported when they enter Canada. If they are reported they can have their PR status revoked. You can't apply to sponsor your baby because you would show CIC that you are not meeting the residency requirement and the process to revoke your PR status will begin. As previously mentioned you will have to wait 2 year before you are in the position to sponsor your child. After you have met the 2 year residency requirement you will have to apply to renew your PR card which may take close to a year to renew. You have a couple of big issues: you can't sponsor your baby, the rest of your family aren't in compliance with their RO and you risk getting reported if you leave Canada and try to enter again. Once your PR card expires you shouldn't leave Canada or your chances of being reported are very very high.

So i should call my family here ASAP leaving the new born in pakistan? Can i apply for visit visa for my new born once she will come here i will apply sponsor from here (canada)??

You have to make your own choices. 50/50 chance that you can get a TRV for your newborn. You can then try a TRP but that may not work either. You can't sponsor your baby until you meet the residency requirement of 730 days within 5 years. The baby will only likely get their PR once your PR card has been renewed successfully.
