Hi

In Feb 2008 I applies for a points based visa as I was dating a Canadian and we decided it would be easier for me to make a move to Canada.

Well, much has changes in that time - we are now married and have a little boy who just turned one. We are living together in England but we really want to make the move to Canada.

I have looked at my Immigration Status and it is now stating that a decision has been made. I assume that this is going to be rejection. I have not been asked for additional medical documents or anything like that. I have emailed my lawyer in Canada who is handling my case but he is not great and we wont be using him again.

Because we knew that the Visa's where going to be cancelled we deiced to do a spousal visa and we are hoping to send it off in the next few weeks. We are doing it ourselves.

What I want to know is if that is the correct course of action? Or, if I have been rejected can I appeal with new information?

We really would like to make the move as soon as possible and want to make sure we go about it the right way.

Any ideas?

Thanks for your response. I have all the forms already - most have been filled in and getting ready to go.

I just don't want to send it in if there is still a chance my Points Visa could be used to get me in quicker.

Damn Shame they canceled all the old visa's - bit of a cheek if you ask me, wish I could call a someone to discuss my current circumstances.

You should assume it's a refusal. Don't bother appealing. It will be very expensive and there's little chance of success.

You should go the spousal sponsorship route as planned.

Hi;

You mentioned that you checked the status on ECAS and it was DM even when no MR or extra documents has been asked, plus it PRE 2008. The most correct guess will be a rejection as you mentioned. Thus your best option is a spousal sponsorship which is the best route you are one right now.

Plus you can examine the FSTC which is currently open and see if you meet or can get the requirement. The other option will be to wait for the FSWC starting in May. There is no harm in filling the spousal sponsorship now as at least that gets you in the queue towards your goal (which is what you want, since time is of the essence) unlike the rest that have to wait til May.

I will also advise you contact seniors like Quorax for advise on if there is any rule against having two applications under different categories running side by side (if cost is not a consideration for you)
