This is my first post here, so sorry if this comes as a repetition... would be happy if someone can answer, or else point me to an applicable thread that reflects a similar case.

My boyfriend and I are a same sex couple, both of Indian nationality, living in Dubai since the past many years. I am in 42 and a seasoned public relations specialist/, while he is 35 and in the petrochemicals industry.

We've had this relationship for the past 7 years and would both like to immigrate and build a future in Canada.

Here is where the nuances come in.
- In 2010, my partner's individual application in the skilled category of a petrochemicals field (not sure which particular category he linked his application with) was rejected.
- Following that and on a separate note, his 2012 application for a Canadian tourist visa also got rejected - obviously his intentions to enter the country were not welcome since his immigration attempt had failed.
- I have never applied for any Canadian permit, so mine is a clean slate.

Now we are not sure of what our best option is to take.
Option 1- Should he re-apply on his own under the "petrochemicals engineer" category? His professional qualifications are now stronger than what they were in 2010. How likely is his second attempt to succeed?
Option 2 - Should I apply on my own under the "Public Relations" category, since I have substantial experience in my profession, but am a bit concerned about age '42'?
Option 3 - Should we apply as a couple (we aren't legally married)?

In case of Option 2, once I get permanent residency, how long would it be before I am allowed to bring my partner in?
In case of Option 3, will my partner's history of unsuccessful attempts at securing the residence/tourist visas affect our 'couple' attempt to immigrate, if I become the primary applicant?

I will be reading about other same-sex cases on this forum.

Thanks in advance!

You should apply together. To apply together, you must either be married or common law. Common law means you have lived together for a minimum of one full year.

If you are common law - but one of you applies as single instead - this means you will never be able to sponsor your partner and may have your own PR status revoked due to misrepresentation (lying about your status). This is why you need to apply as a couple if you have lived together for at least a year.

It doesn't matter who the primary applicant is. As long as you meet the program requirements you can apply.
