I have applied for the Permanent Residency in Canada and my class falls in the Category 1. I have sent documents to the Nova Scotia, Canada and got response from there describing that the job what I have indicated (Job Title: Teaching Assistant, Code: 4131) has lack of job explanation. I had again sent explaining the job description for the said title, but got negative response from there describing that my job description is not matched what have asked in their requirement. Now, I am confused whether I can apply again for the same category or I have to wait for a long time. For understanding my situation, I am sending the letter what I have got from the immigration centre Canada and the job description what I have sent for Teaching Assistant.[/color]

First of all, I would like to thank you for your kind response to my application for “Federal Skilled Worker Class”. I was asked to fulfill the requirement of the application belonging to Regulation 10 of the Immigration and Refugee Protection Regulations that is described in Appendix C. Therefore, I am resubmitting the application again by answering the query in Appendix C. I have rechecked all the documents again and have provided detailed description of main duties for “Teaching Assistant”. The details of my job are described below:

you may have performed many of the duties mentioned there, but wording is the main issue. People who are assessing your application don't know much about all occupations, so they go by wording only.

try again? maybe... seek PMM, Leon and BCGuy's opinion on this.

As the OP says, s/he was a teaching assistant which is 4122 in the NOC, so not eligible.

Man teaching assistant does not fall under NOC code (4131) at all !!! it belongs to codes (4122) and (6472) which both do not fall under the list of 38 jobs announced by the minister (means they are ineligible).

Secondly, if they assume that you have just written the job tittle by mistake and have been doing the main duties indicated at the NOC website under code : 4131 (College and Other Vocational Instructors), your job description doesn't match the one under that code at NOC website at all.

Sorry for your refusal but they haven't made any mistake in their decision.

there is a duties' mismatch with the main duties of 4131 and also you selected a wrong title (teaching assistant) that is not belong to 4131. I predict those two points are the main reasons for your refusal.

You can apply as many times as wish, but you still won't be eligible.

Is it so that I won't be eligible if I apply again changing my job title an job descriptions?
 
Hi,

The problem is when you reapply you have to mention that 'You had applied before ' in one of the forms.

Now lets say if you change your job and become a college teacher fitting NOC 4131, in this case also you would need to wait for 1 year to be able to qualify

Another thing is that if you just change your duties in the form and reapply -i will doubt this one as CIC may have a record of your previous application and they might consider is as misrepresentation as they had asked you for detailed duties which you had provided and they were not satisfied with those, so they wont agree with the new application as you cant just change your duties in a month.

This is my opinion, i would like to hear what other senior friends think.

reachmenow is right , they will definitely look at your first application and when they see that you have changed the duties completely to fit with other NOC , they might refuse your application because of the misrepresentation.

To be very frank with you , you would not be able to hear a comforting response from any of the members here because of your case rejection criterias.

The best advise to you would be to immediately consult a reputed immigration lawyer, explain him all the details - show all the details of those forms filled, letter with duties and the rejections letter.

If he gives some postiive comments then with his help you try to reapply although i cant think of any other alternatives to be able to reapply immediately.

Thank you for your kind suggestion. I do not mean to change the duties regarding NOC 4131, but the duties what I have in my experience letter for teaching assistant were fully not represented in my previous application. I had just described some specific duties regarding 4131 in the application thinking that not necessary to describe the common duties of teaching assistant and if I would present all the duties would be so long descriptions. Now, I wonder if I apply describing all duties what I have in my job experience letter can provide me the chance to move from here? Please help me giving your suggestions.
 
Sushilmuna - if you look at your experience letter, is there anything in it that overwhelmingly suggests that you are a college lecturer?

For example, if it says you graded homework, then this is not a job of a lecturer only, but also of a teaching assistant. But if you supervise masters student project, this is a job of a lecturer. Do you have duties that are specific to lecturers and that one would read it and say, you did lecturer duties.
