Hi,

I NEED SOME ADVICE HERE...my friend who applied for refugee claim in 2010 was denied and his prra was also denied in 2012..he was asked to report to border services on sept 10,2012. when he went there he was detained for a week. then we posted a bond for him and he was released and was provided a ticket to be send back to India the next day. So right now he is in India but his employer wants him to come back to Canada to work. He has a work permit that is valid till March 2013. I would like to know what are his options to come back to canada. His employer has provided him with a letter stating that they need him on some projects that he can only work on.
Is his work permit still valid?or does he have to apply for new work permit?
does he need an LMO? because he was already having a fulltime job when he was deported from Canada since the last one yr.
can he apply for an ARC right now or does he have to wait for an year?

please advice soon....

1. Not a chance in the world that is coming back on a work permit.
2. Deported, claimed refugee status, proves would not leave, and work permit is no longer valid.
3. He can applied for an ARC any time he wants with an approved LMO, but a waste of $$$$
 
If he wants to return, his best option is probably to apply to immigrate as a skilled worker (if he qualifies). He'll still need an ARC.
