Hey there!
It's been year I'm here in Canada in student visa. Unfortunately right now I'm in a bad situation. I don't have anyone except my mom.she finances me till now but now she is sick & it's getting at for her to pay.Right now i can't go back home also cause my mom dad got divorced & many times my dad tried to take me away from her. My mom filed a case against him Which is still processing in court. A part from this when I was back in home a guy tried to rape me & then many times he tried to harm me & threatened me to withdraw the case against him I filed. Still he gives threate to my mom. So my question is can I claim refugees & after that can I study besides that or after that??

You should speak to a lawyer about your complete asylum claim since your case is not a clear asylum claim. Do you have police or court records for the attempted rape? Have you tried to relocate in your home country. It is unclear what is going on with your parents but you must be an adult at this point. You’d have to get a new study permit after you filed an asylum claim. You also only qualify for international fees. Asylum hearing can take over 2 years to get in some cases.

Getting an degree and PGWP allows you to have much more control about you future. I strongly encourage you to speak to a lawyer about what proof you have and your chances of getting asylum. Getting your claim refused has long lasting implications.

You should speak to a lawyer because this seems to be routed in a family dispute of some sort. The other issue is you have not tried to relocate within your country which a big reason many get refused asylum.

You can't transfer your asylum case to Canada.

Asylum cases do regularly get refused in Canada as well.
