Hi, my name is Ramesh. I am a refugee claimant which was rejected and I have already applied for the judicial review. So my question is that is there any way that I can stay in Canada without being illegal. Is there any possibility of getting the study permit as I came in study permit. Please somebody help me to find the answer.

In my opinion you have no chance of being approved for a study visa. To be approved you must show you have strong ties to your home country and no plans to remain in Canada long term. Obviously the refugee claim will make it impossible for you to prove this.

1. As s/he has applied for leave to appeal, which will take more than 30 days, his removal order is going to turn into a deportation order if s/he loses at Federal Courts. That pretty well ensures that s/he won't be coming back as a student.

If refused in review, the only option is illegal hiding. Usually, they send deport letters after that.
