Hi everyone, I need help with how to become a PR inside Canada. This is a story of my friend, it is quite complicated. She is 60 years old now and she doesn't really speak English. She arrived in Canada in 2009 and her Refugee Claim was refused (I am not sure when she applied). The reason of rejection was that the gender on her refugee docs did not match or somehow it was incorrect. She hasn't find any lawyer to help her since then. As far as I know, every 3 or 6 months, she needs to go to the Immigration office in Mississauga to have a meeting with them. In 2016, she married with a Canadian and he is definitely eligible to sponsor her. I am not sure about her exact status in Canada, but she does have a work permit which will be expired soon. Since the Refugee Claim was refused, I will be applying the Spouse Sponsorship for her. The biggest challenging to proceed her PR application is that she does not have her original passport. Can anyone guide me what to do to complete her application?

Thank you

You may want to know all specific situation before you decide to apply. Go through all eligibility criteria and confirm whether she can be sponsored, or if there is any issue you need to overcome

There must be more to this story if she has a WP.

As others have said look through Family Class and Spouse in Canada Class sponsorship to see if she is eligible, confirm that first.
Also may be worth figuring this out before her work permit expires. Im curious how she has a work permit?
Where is her passport? Does she have a copy of her passport and is her passport valid?
We would need more information to be able to guide you.

Is there a reason why her husband didn't submit an application to sponsor her years ago? He could have done this in 2016 and she would have become a PR a long time ago.

If they want to submit the application now, you follow the instructions here: https://www.canada.ca/en/immigratio...l-partner-dependent-child-complete-guide.html

It was my mistake that her PR application (not Refugee Claim) was rejected through the Refugee program. I think she is eligible to apply the Family Class and Spouse in Canada Class sponsorship.
I guess she needs a work permit to work in Canada as she is a refugee clamant
She came to Canada as a refugee claimant, which meant she didn't have her passport from her home country, and was unable to renew it

Was she a refugee resettled to Canada or did she make an asylum claim? Both are extremely different. What has her immigration status been for 20 years? How did she qualify for a WP or has she been working for cash?

Her Refugee was refused, and do you know whether she appealed? If she didnt, then she is no longer a refugee claimant anymore since her claim was refused. There is a lot of "I think" "I guess" on both of your statements,

Refugees are approved abroad so if in Canada her refugee application would have to have been approved. Asylum claimant is someone who claims asylum in Canada.
