Hi,

I posted this in the February thread as well but hoping to get a quick answer to get the documents out this morning. We received an email from the Pretoria VO today as follows:

This refers to your application for permanent residence in Canada.

The following documents are required:

- It will be necessary for you to sign the attached Statutory Declarations in the presence of a Notary Public and return the originals to our office. (Attached.)

- It will be necessary for you to sign the attached Statutory Declaration of Common-Law Union in the presence of a Notary Public and return the original to our office. (Attached.)

- Please correctly complete Questions 16 and 17 of your Generic Application Form for Canada form. (Attached.)

We should receive the above mentioned documents within 60 days. Failure to meet this deadline may result in the refusal of your application.

-----------------------------------------------------------------------------------------------------------------------------------

The statutory decelerations are fine, I understand those as they relate to my children who are part of the application but will not accompanying me at this point.

However, they have asked to correctly complete questions 16 and 17 of the Generic Application Form for Canada. It doesn't make sense and I am wondering if they made a mistake. They sent page 4 which contains the information of my dependent child. I answered "single" and "No" respectively for questions 16 and 17.

Would someone mind confirming that I answered this correctly please and that it is in fact a mistake on the VO's side?

I would like to email them and inform them today while I get the remainder of the requested documents notarized and sent.

Thank you,

can you repeat what the questions actually state so we can possible help you better?

Thanks, they are as follows:

16. Your current marital status - "Single"

17. Have you previously been married - "No"

These questions are on page 4 and within the dependent section.

I am pretty sure they made a mistake and that I answered them correctly but just want to double check.

are you sure these questions are actually referring to the dependant? They may actually be referring to the "principle applicant" who is you. Hopefully someone else will be able to provide insight for you...

I'm pretty sure it relates to the dependent as I have two children and added another dependent section to the form originally. The questions for the 2nd dependent are exactly the same, it also has a 16 and 17 asking about marital status and whether married before. I obviously answered it the same as in "Single" and "No" but they only raised the issue with regards to the answers for the one dependent and only sent the single page for that particular dependent.

if you don't get answers from senior members, i would suggest returning the original form they sent, and writing a letter to the visa office explaining your confusion as to why they suggest the answers are wrong when it is referring to your dependant child when they are in fact correct. Maybe you can even send the visa office a case specific email before sending everything to double check what they mean? Perhaps it really is just a mistake on their end... good luck! let us know how it turns out.

Thanks. I'm going to reply to the email and send the form again with the explanation. I'm 99.9% sure they made a mistake but also so worried about wasting time.

They are asking you to sign a statutory declaration of common law, so I suspect they may be referring to YOUR part of the application and mistakenly included that of your child instead. How did you answer question 16/17 in YOUR application? You should answer 'married' because you are obviously at minimum considered common law at this point.

Form IMM0008 (for the applicant) does not have a question 16 or 17 (ends with question 14 in Personal Details section). I'm inclined to agree with the OP that this is an error, since IMM0008DEP DOES have questions 16 and 17.

IMM0008, Question 2, asks: Category under which you are applying, which would be common-law partner, not married. This is the only question on the entire form that asks about the applicant's marital status.

Thanks Ponga. We have occluded that it is a mistake so sending a letter of explanation along with motorized statutory declerations.
