Visa Office......
Sydney, NS
Hi all,

I am working in Toronto, Canada. Currently on Temporary Resident Visa and an Open Work Permit. I have been living in Toronto for slightly more than 2 years now.

I am getting engaged and married in India in Feb 2015. I will be staying for not more than a week after my marriage (due to work restrictions). I would like to bring my wife along on my return journey. What are the possible (and legal) options I could explore, so I may not leave her alone in India? I don't want to lie or fabricate my case and land myself in trouble later.

Can she apply for a visitor visa now, just so that she can come along with me - even if processing of the actual immigration application filed after marriage gets delayed? If so, can she change her status or get a work permit while in Canada?

I know there are other threads with similar questions...but most of them are outdated and apply to PRs. Would appreciate if you could direct me to relevant resources.

Thanks.

Sure - she can try appling for a TRV now. To be approved she will need to show that she has strong ties to her home country and no plans on remaining in Canada long term.

Hello
i am in India and my wife is in canada for 5 years now in work permit
We got married in sep 2015 and applied for the PR .She added me in PR as her PR had to come in OCT and now delayed

I applied for visitor visa also to come in dec 2015 but it got denied with following reasons :-

1. Not satisfied with sufficiant funds:- I have Rs 6 lakhs ( 12,000 CAD ) Approx and Rs 2 lakhs of fixed deposits ( 4000 CAD Approx )

2. Insufficient evidence to establish the relationship with your host :- I deposited the court of law marriage certificate to you signed by the registrar of the court which is legally accepted in INDIA

Additionally i submitted
Employment Letter
Leave of Absence Letter
Bank Balance letter ( Balance Certificate )
Wife's documents were also as per order

Please confirm what else can i give as a marriage proof as i already submitted the registered court marriage certificate

Thanks

Hi Tarun,

First off, please do not post your questions in several threads across this forum.

As for your TRV refusal:
Not satisfied with sufficiant funds:- I have Rs 6 lakhs ( 12,000 CAD ) Approx and Rs 2 lakhs of fixed deposits ( 4000 CAD Approx )
Was any of this money deposited last-minute in your bank account? Does it match your earnings?

Insufficient evidence to establish the relationship with your host :- I deposited the court of law marriage certificate to you signed by the registrar of the court which is legally accepted in INDIA
There is no such thing as a *Court Marriage*..... Indian courts do not solemnize marriages. What you're referring to is a *Registered Marriage*.

Are these the exact words stated for your TRV refusal?
Have you submitted the original marriage certificate with your TRV application or an attested copy?

It seems the visa office is not convinced you are married and/or the evidence submitted for your marriage.

It is not easy to get a TRV if you have an ongoing PR application. The overall evidence you have submitted is not good enough to convince the visa officer that you will return home at the end of your visit. You may want to present stronger ties if you reapply

Cheers
