Dear Qorax and professional1,

My post-graduate work permit is expiring on 29 June 2010. My complete documents were submited at Buffalo Consulate on 29 March, 2010. Buffalo AOR is still awaited. My departure from Canada is booked for 27 June. Am I running a risk with my PR application? Will leaving Canada while PR application is pending disqualify me?

You comments will be appreciated.

Hi Verma,

There won't be any 'disqualification' per se, in moving out of Canada. However, u might face a daunting task for 2 things, if u r heading back to your homeland:

1. Attending an Interview call, if any.
2. Sending your Pps for stamping.

I'm sure u had looked at that angle when u chose to select Buffalo as your VO.

First of all, please accept my apology for addresing you wrongly (Oorax) which I have modified now. Your quick comments are much appreciated. I have thought of the two points you have mentioned. I have some compelling reasons to return to India and am prepared to travel for interview if called for.

I am also considering to request Buffalo Consulate to transfer my file to New Delhi, as I have beeing reading on these forums that this is doable and a few applicants have been successful.

Buffalo Consulate received my complete docs on 29 March 2010, but AOR from them is still awaited. What could be the cause? Is it an indication for rejection or some shortcomings in the file?

Kindly share your thoughts.

Dear Verma,

The Visa Office cannot be transfered on our requests [come what may], except by the CIC for Program Integrity Reasons. Read below what the Manual says:

CHANGING VISA OFFICE:
Visa offices are not required to transfer files for any other reasons. Such reasons include cases of applicants who comply with subsection R11(1) for the specified visa office, at the time the application is received at the CIO, but subsequently leave the territory of the specified visa office. In these cases, the original visa office should proceed with a final determination of eligibility and process the application if eligible. The visa office should not transfer the file to another visa office unless the transfer is warranted for program integrity reasons. Leaving a visa office's territory alone does not warrant a file transfer. In this case, if an applicant requests a file transfer, the visa office should inform them that the application will not be transferred and that they are required to submit a complete application to the visa office originally specified within the 120 day deadline allotted by the CIO.

Hi Vermas,

As Qorax mentioned above, there will be no problem for you leaving canada unless they find out some lack of evidence to be eligible under category 3 (from their point of view in the visa office) when they start doing the eligibility review again at the visa office, which i am pretty sure is not applicable in your case. (because in such a situation, they will bring you back to the zero point to approve your eligibility under FSW 3).

I have a question for you: When you sent them your full documents, did you attach a copy of the approval letter from the CIO ? and what is your e-case status showing right now ?

Do not worry about the delay of your AOR as long as you are able to see the change of your e-case to be "Received by the visa office", you are fine. Buffalo sometimes delays the AOR for unknown reasons.

Thanks for your comments. Yes, AOR from CIO was attached with the documents submitted to Buffalo. e-CAS continues to show:

"We received your application for permanent residence on December 31, 2009.

We reviewed your application and sent you a letter on February 23, 2010. Please consider delays in mail delivery before contacting us."


I am really concerned that this status is not changing and I am leaving Canada on 27 June. I would like to send a few updated documents to them, such as:an updated refrence letter from my current employer, my latest bank statement (as POF), change of status (returning to India) and copy of my new passport (issued 3 weeks back).
