Spousal Sponsorship Application Submitted - December 15th 2011
Received AIP - September 12th 2012
Reeived PRRA notice - September 28th, 2012
Previously CBSA would stay the removal order in cases such as ours. However it seems things are changing and they no longer offer the administrative defferal. Can anyone shed any insight on how CBSA is proceeding with PRRAs for spousal sponsors with AIP? It seems absolutly ridiculous that they would proceed with a removal order for someone who has a AIP from CIC and is a month into the PR process.

If you are working with an attorney, I would suggest asking her or him.
Note: there is an option to apply to Federal Court for review. Given the Fear, Uncertainty and Doubt in this area you may find that there are some groups willing to challenge the law in Federal Court. All YOU need is to buy time, of course, and you can ask the Court to block enforcement of the removal order pending the outcome of the leave application and/or JR application.
Sorry I forgot to mention, that he is PRRA eligble having recived the negative IRB decision over a year before the PRAA date.
Our lawyer is going to try to get CBSA to defer the PRRA meeting entierly. She said that CBSA previously would defer if you submitted your spousal sponsorhip app before the PRRA date, HOWEVER now they generally will if you have an AIP.
