i have received a procedural fairness letter from my VO as my consultant uploaded my educational degree in place of my work experience/reference letters by mistake.the VO has given me 30 days to respond with all the supporting documents which i am in the process of collecting now.Now my concern is that if after the submission of my documents and LOE i get rejected,do i get banned for 5 years for sure or it depends on my case..i am really stressed out.your help would be appreciated
16 (1) A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires
40(1)(a) A permanent resident or a foreign national is inadmissible for misrepresentation. for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;
40(2)(a) the permanent resident or the foreign national continues to be inadmissible for misrepresentation for a period of five years following, in the case of a determination outside Canada, a final determination of inadmissibility under subsection (1) or, in the case of a determination in Canada, the date the removal order is enforced.
i understand the definition of the codes but i want to understand that in case of a rejection,is it definite that i might get a 5 year ban.i am trying my best to collect all the documents to support my case though.
After seeing the letter I believe this is not something to be completely concerned with.
Technically the way the VO see's this now is that you have said you worked for a company but all they see as evidence is a degree certificate.
So, the officer now wants you to upload the documents you should have done but please, please, back it up with more. Fill up the 4mb pdf and attach a LOE with "My lawyer uploaded the incorrect PDF, not my intention to mislead...."
Get lots of evidence. Get a letter from other employees or another supervisor.
As long as you provide evidence now you will be fine! Lots of people get this and come back from it. The 5 year ban is scary, but if you can back it up you will be ok.
